Part A — Retail Terms & Conditions

These Terms & Conditions apply to all in-store purchases made at Les Néréides Australia retail locations. They do not apply to Wholesale purchases.

Change of Mind

Les Néréides Australia offers an exchange for change-of-mind purchases on full-price items returned within seven (7) days of purchase, provided a valid proof of purchase is presented and the item is in its original, unused and resaleable condition with all original packaging and tags attached. This is a discretionary policy and does not constitute a legal entitlement. We do not offer refunds for change-of-mind purchases under any circumstances.

Sale & Discounted Items

Our change-of-mind exchange policy does not apply to sale or discounted items. No exchange or credit will be offered on sale or discounted items for change-of-mind reasons. Your rights under the Australian Consumer Law are not affected by this policy.

Earrings

For hygiene reasons, earrings are excluded from our change-of-mind exchange policy and cannot be returned or exchanged once purchased, except where required by law.

Lay-by

Lay-by must be collected within three (3) weeks from the date of purchase. A lay-by agreement may be cancelled by the customer at any time prior to collection. In the event of cancellation, a reasonable termination charge may apply. The balance of any amounts paid will be refunded. Full Lay-by Terms & Conditions are available at the point of sale and on this page below.

Voluntary Warranty

As a goodwill benefit and in addition to your rights under the Australian Consumer Law, Les Néréides Australia offers a voluntary warranty of twelve (12) months from the date of purchase on full-price items, and six (6) months on sale items. This voluntary warranty does not replace, limit, or reduce your rights under the Australian Consumer Law, which apply independently and without a fixed expiry date.

Gift Cards

Gift cards are non-refundable and cannot be redeemed for cash. Gift cards are valid for a minimum of three (3) years from the date of purchase in accordance with Australian law. Gift cards are not redeemable after the expiry date and no extension will be offered.

Faulty Items & Assessment

Where a product is believed to be faulty, Les Néréides Australia reserves the right to physically assess the item prior to offering any remedy. All items will be photographed and inspected at the time of presentation. Les Néréides Australia reserves the right to take into account the visible condition of the item, evidence of wear, and consistency between the item's condition and the reported usage history when determining whether a fault is of manufacturing origin. Items showing signs of wear, damage, or use inconsistent with the reported history may be assessed as not meeting the threshold for a remedy under our policy or the Australian Consumer Law.

Faults caused by misuse, accidental damage, abnormal use, exposure to chemicals or moisture, or failure to follow care instructions are not covered. Where a genuine manufacturing fault is confirmed, a remedy will be determined in accordance with the Australian Consumer Law. For minor failures, Les Néréides Australia will determine whether to repair, replace, or refund at our discretion. For major failures as defined under the Australian Consumer Law, consumers may be entitled to choose their preferred remedy.

Incomplete or Partial Items

Where only part of a set or pair is presented for assessment (for example, a single earring from a pair), assessment will be conducted solely on the item available for inspection. Les Néréides Australia reserves the right to decline a remedy where no manufacturing fault can be identified on the item presented. The absence of part of a set does not in itself constitute evidence of a manufacturing fault.

Your Australian Consumer Law Rights

Our policies operate alongside your rights under the Australian Consumer Law (ACL) and nothing in these Terms & Conditions is intended to exclude, restrict, or modify those rights. Under the ACL, consumers are entitled to certain guarantees in relation to goods and services. Where a product fails to meet a consumer guarantee, you may be entitled to a repair, replacement, or refund depending on the nature of the failure. For further information about your consumer rights, visit www.accc.gov.au.

Part B — Online Store Terms of Service

This website is operated by Les Néréides Australia. Throughout the site, the terms "we", "us" and "our" refer to Les Néréides Australia. Les Néréides Australia offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following Terms of Service, including those additional terms and conditions and policies referenced herein. These Terms of Service apply to all users of the site, including browsers, customers, merchants, and contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. Any new features or tools added to the current store shall also be subject to these Terms of Service. We reserve the right to update or replace any part of these Terms of Service by posting changes to this page. Your continued use of the website following any changes constitutes acceptance of those changes.

Our store is hosted on Shopify Inc., which provides us with the online e-commerce platform that allows us to sell our products and services to you.

Section 1 — Online Store Terms

By agreeing to these Terms of Service, you confirm that you are at least 18 years of age, or that you have the consent of a parent or guardian. You may not use our products for any illegal or unauthorised purpose, nor may you violate any applicable laws. You must not transmit any worms, viruses, or code of a destructive nature. A breach of any of these Terms will result in immediate termination of your access to our Services.

Section 2 — General Conditions

We reserve the right to refuse service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without express written permission from us. Credit card information is always encrypted during transfer over networks.

Section 3 — Accuracy, Completeness and Timeliness of Information

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon as the sole basis for making decisions. We reserve the right to modify the contents of this site at any time without obligation to update any information. Historical information provided on this site is for reference purposes only.

Section 4 — Modifications to the Service and Prices

Prices for our products are subject to change without notice. We reserve the right to modify or discontinue the Service, or any part thereof, at any time without notice. We shall not be liable to you or any third party for any modification, price change, suspension or discontinuance of the Service.

Section 5 — Products and Services

Certain products or services may be available exclusively online. These products may have limited quantities and are subject to our Returns & Refunds Policy set out in Part A of these Terms and in our Refund Policy.

We have made every effort to display the colours and images of our products as accurately as possible. We cannot guarantee that your device display will accurately reflect product colours. We reserve the right to limit the sale of our products to any person, geographic region or jurisdiction, and to limit quantities at our sole discretion. Product descriptions and pricing are subject to change at any time without notice. Any offer for a product or service is void where prohibited by law.

Section 6 — Accuracy of Billing and Account Information

We reserve the right to refuse any order. We may limit or cancel quantities purchased per person, per household or per order, including orders placed under the same account, credit card, or billing and shipping address. In the event that we modify or cancel an order, we will attempt to notify you using the contact details provided at the time of the order.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store, and to promptly update your account information as required.

Section 7 — Optional Tools

We may provide access to third-party tools over which we have no control. Access to such tools is provided "as is" without warranties or endorsement of any kind. Any use of optional third-party tools is entirely at your own risk. We may also offer new features or services in the future, which will be subject to these Terms of Service.

Section 8 — Third-Party Links

Certain content or services available via our website may include materials from third parties. Third-party links may direct you to websites not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of third-party sites, and we do not warrant and will not have any liability for third-party materials, websites, products or services. We are not liable for any harm or damages related to transactions made through third-party websites. Please review third-party policies carefully before engaging in any transaction.

Section 9 — User Comments, Feedback and Submissions

If you send us creative ideas, suggestions, proposals or other materials (collectively "comments"), you agree that we may, at any time and without restriction, use any comments that you submit. We are under no obligation to maintain comments in confidence, pay compensation, or respond to comments. We may monitor, edit or remove content that we determine to be unlawful, offensive, or otherwise objectionable. You agree that your comments will not violate any third-party rights or contain unlawful, abusive or obscene material. You are solely responsible for any comments you make and their accuracy.

Section 10 — Personal Information

Your submission of personal information through our store is governed by our Privacy Policy, which forms part of these Terms of Service.

Section 11 — Errors, Inaccuracies and Omissions

Occasionally information on our site may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, availability or shipping charges. We reserve the right to correct any such errors and to update or cancel orders where information is inaccurate, without prior notice.

Section 12 — Prohibited Uses

In addition to other prohibitions set out in these Terms, you are prohibited from using the site or its content for any unlawful purpose; to solicit others to perform unlawful acts; to violate any applicable laws or regulations; to infringe upon intellectual property rights; to harass, abuse, defame or discriminate against any person; to submit false or misleading information; to upload or transmit viruses or malicious code; to collect personal information of others without consent; to spam or engage in phishing; or to interfere with the security of the Service or any related website. We reserve the right to terminate your access for any violation of these prohibited uses.

Section 13 — Consumer Guarantees and Limitation of Liability

Nothing in these Terms of Service excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited. If the Australian Consumer Law applies to a supply of goods or services under these Terms, then to the extent permitted by law:

Our liability for a failure to comply with a consumer guarantee in relation to goods that are not of a kind ordinarily acquired for personal, domestic or household use or consumption is limited, at our option, to replacement or repair of the goods, or payment of the cost of replacing or repairing the goods; and
Our liability for a failure to comply with a consumer guarantee in relation to services is limited, at our option, to the resupply of the services or payment of the cost of having the services resupplied.

Subject to the above and to the extent permitted by law, we exclude all implied terms, warranties and conditions other than those set out in these Terms. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss or damage arising from your use of our Service or products procured through the Service.

Section 14 — Indemnification

You agree to indemnify and hold harmless Les Néréides Australia and its officers, directors, employees, affiliates, contractors and service providers from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party.

Section 15 — Severability

If any provision of these Terms of Service is found to be unlawful, void or unenforceable, that provision shall be enforceable to the fullest extent permitted by applicable law. The unenforceable portion shall be severed from these Terms without affecting the validity of any other remaining provisions.

Section 16 — Termination

These Terms of Service are effective unless and until terminated by either you or us. You may terminate at any time by notifying us that you no longer wish to use our Services, or by ceasing to use our site. If, in our sole judgement, you fail to comply with any provision of these Terms, we may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to the date of termination.

Section 17 — Entire Agreement

These Terms of Service, together with any policies or operating rules posted by us on this site, constitute the entire agreement between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, whether oral or written. The failure of us to exercise or enforce any right or provision shall not constitute a waiver of that right or provision.

Section 18 — Governing Law

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales.

Section 19 — Changes to Terms of Service

You can review the most current version of these Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service at our sole discretion by posting updates to this page. Your continued use of our website following any changes constitutes acceptance of those changes.

Part C — Lay-by Terms & Conditions

The following terms apply to all lay-by agreements entered into at Les Néréides Australia retail stores.

Lay-by Agreement

A lay-by agreement is formed when you make an initial payment on a product and agree to pay the balance by an agreed date, with the product held in store until full payment is received. All lay-by agreements are subject to the Australian Consumer Law.

Payment Schedule

The full balance must be paid and the item collected within three (3) weeks from the date of the initial lay-by payment unless otherwise agreed in writing with the store manager at the time of the lay-by. Lay-by payments may be made in-store only.

Cancellation by the Customer

You may cancel your lay-by agreement at any time before collection. Upon cancellation, Les Néréides Australia will refund all amounts you have paid, less a reasonable termination charge to cover administrative costs associated with the lay-by. The termination charge will not exceed the amount you have paid and will be advised to you at the time of cancellation.

Cancellation by Les Néréides Australia

We may cancel a lay-by agreement if the full balance is not paid within the agreed period. In this event, we will notify you and provide a full refund of all amounts paid, less a reasonable termination charge.

Goods on Lay-by

Title to lay-by goods does not pass to you until all payments have been made in full. Lay-by goods will be held securely in store. We cannot accept responsibility for product discontinuation during the lay-by period, however in such a case a full refund of amounts paid will be provided.

Remedies for Confirmed Faults

Where a manufacturing fault is confirmed following assessment, Les Néréides Australia will determine the appropriate remedy in accordance with the Australian Consumer Law. For minor failures, Les Néréides Australia reserves the right to offer a repair or replacement as the primary remedy. Where the exact item is no longer available, we will offer a replacement of equivalent value or a store credit for the full purchase price, subject to the customer's agreement. For major failures as defined under the Australian Consumer Law, consumers may be entitled to choose their preferred remedy.
